Ministerio de Relaciones Exteriores Comercio Internacional y Culto Reveived: 23 Sep 1996 ARGENTINE CENTRAL AUTHORITY: OPERATION PETITION FOR RESTITUTION OR ACCESS ABROAD 1 - The operation of the Argentine Central Authority is administrative and informative, it is always the Judicial Power who decides on the application. 2 - Once the application is received at the Central Authority, we verify that the petition fulfills the Convention's requirements, and with the petitioner's authorization, we contact the respondent inviting him to accept voluntary restitution or access. 3 - If the respondent fails to accept voluntary restitution or access, the application should be filed by a private attorney before the competent Court. Likewise, the Central Authority sends a letter to the Judge in charge, informing about the Convention's operation, offering further cooperation. 4 - The Argentine Central Authority doesn't represent individuals, who should hire a local lawyer to file the application before the Court. Those petitioners that haven't got resources for the attorney fees, and are proved to be eligible to receive legal aid at their habitual residence country, will be represented by a Public Defender appointed by the Court. /s/ (Illegible)
